Terms of Service

These terms are an agreement between you and Focus Digital d.o.o. (OIB 78356705721), Borongajska cesta 82/3, 10000 Zagreb, Croatia ("Keeplooped", "we", "us"), which operates Keeplooped. By creating an account or using Keeplooped you accept them. If you accept for a business, you confirm you can bind it, and "you" means that business.

1. The service

Keeplooped is software for local businesses to answer leads, send texts and emails, run follow-ups, take bookings, and manage loyalty, referrals, offers and reviews. We may add, change or remove features. If we materially reduce something you rely on, we will give reasonable notice.

2. Accounts

  • You need accurate details to sign up, and you keep sign-in details safe.
  • You are responsible for everything done under your account, including by your staff and any agency you give access to.
  • You can give an agency access to your account and remove it at any time.

3. Plans, billing and cancellation

  • Paid plans are billed in advance through Stripe, monthly or yearly, and renew automatically until cancelled.
  • Texting, calling and email usage beyond your plan's allowance, carrier registration fees and pass-through carrier fees may be billed separately, as shown in your account.
  • Plans have fair-use limits described in your account. We may ask you to move to a larger plan if you consistently exceed them.
  • You can cancel at any time. Service continues until the end of the paid period. We do not refund partial periods unless the law requires it.
  • We may change prices with at least 30 days' notice. The new price applies from your next renewal.
  • If payment fails, we may limit sending until it is fixed, and suspend the account after reasonable notice.

4. Texting, calling and email

Every text, call and email is sent on your behalf and in your name. You are the sender and are responsible for having consent, the content you send and following the law. Our Communications Terms form part of these terms and govern all messaging. Keeplooped's built-in rules (consent checks, quiet hours, opt-out handling) reduce risk but do not guarantee compliance, and they do not replace your own legal advice.

SMS terms for texts from Keeplooped. If you opt in (for example on keeplooped.com/demo), Keeplooped, operated by Focus Digital d.o.o. (OIB 78356705721), Borongajska cesta 82/3, 10000 Zagreb, Croatia, sends you texts about your demo request, your account and Keeplooped offers. Message frequency varies; up to 4 marketing texts a month. Message and data rates may apply. Reply STOP to opt out and HELP for help, or email hello@keeplooped.com. 5. Your data

  • You own the data you put into Keeplooped. You give us a limited licence to host and process it only to provide the service to you.
  • We process personal data about your clients as your processor, under our Data Processing Agreement, which forms part of these terms.
  • You can export your data while your account is active and for 30 days after it closes. After that we delete it as described in our Privacy Policy, except records we must keep.

6. AI features

AI replies, drafts and suggestions are generated from the information you give Keeplooped. They can be wrong. You decide whether to switch them on and what they may answer, and you are responsible for what is sent in your name. We do not use your content to train AI models.

7. Acceptable use

You will not use Keeplooped to:

  • break the law or anyone's rights, or send content banned by our Communications Terms (Schedule B)
  • send messages to people who did not agree to hear from you, or to bought, rented or scraped lists
  • upload malware, probe or overload the service, or get around its limits and rules
  • resell Keeplooped or use it for another business without our written agreement
  • collect sensitive health data beyond what booking an appointment needs

We may suspend features or accounts that break these rules, as described in the Communications Terms.

8. Third-party services

Keeplooped connects to services such as Stripe, Google, Meta and booking systems. Your use of them is governed by their own terms. We are not responsible for them, and a change on their side may change what Keeplooped can do.

9. Availability and support

We aim to keep Keeplooped available at all times but do not guarantee it. Planned maintenance happens outside US business hours where possible. Support is by email at hello@keeplooped.com.

10. Ending the agreement

You can close your account at any time. We may end these terms or suspend the account for a serious or repeated breach, for non-payment, or where the law or a carrier requires it. Sections that by their nature should survive (payment, your responsibility for messages, liability, and governing law) continue after the account ends.

11. Warranties and liability

  • Keeplooped is provided "as is". We do not promise it will be error-free or meet every need.
  • Neither party is liable for indirect or consequential losses, such as lost profits or lost business.
  • Our total liability in any 12 months is limited to the fees you paid us in those 12 months.
  • These limits do not apply where the law does not allow them, or to your obligations under the Communications Terms (including indemnification), which are not capped.

12. Changes to these terms

We may update these terms. For material changes we will email account owners at least 30 days before they take effect. Continuing to use Keeplooped after that means you accept them.

13. Governing law

These terms are governed by the laws of the Republic of Croatia, and the courts of Zagreb have exclusive jurisdiction, without limiting any rights consumers have under the law of their own country.
